In terms of their content, the development of norms regarding labour during five decades of existence of the EC has been spasmodic, episodic and unsystematic. They have ranged unsystematically from norms in which the principle of freedom of movement in a Community-wide labour market overrides social considerations of protection of workers (as when technical standards for products are stipulated which are lower than national labour law standards,) to norms which have provided rights and protection far beyond existing Member State provisions (as in equality between men and women).

But the law operates to limit the potential creativity of the EC institutions within the confines of the competences allowed for by the Treaties. One example of this approach arises from the provisions of Article 51 of the EU Charter of Fundamental Rights adopted by the European Council at Nice in December 2000. This purports to limit the scope of application of the Charter:81 1. The provisions of this Charter are addressed to the institutions and bodies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law.
